Quick answer

Your final settlement in the UAE is your end-of-service gratuity, plus pay for every unused annual-leave day, plus pay in lieu of any notice you were not allowed to serve, plus salary still owed, less lawful deductions. Gratuity and unused leave are both calculated on your basic salary (Articles 51 and 29 of Federal Decree-Law No. 33 of 2021), while notice pay and outstanding salary use your full wage. Gratuity needs one completed year of service; the other components do not. Article 53 requires the whole settlement within 14 days of the contract ending.

What goes into a UAE final settlement

A final settlement is not one figure but four, each owed under its own article. This UAE settlement calculator works each one out with the same engine that powers the standalone UAE calculators, so the gratuity here matches the UAE gratuity calculator exactly and the leave figure matches the leave salary calculator.

Federal Decree-Law No. 33 of 2021. Notice is 30 to 90 days under Article 43. Daily rates divide the relevant monthly wage by 30.

How a UAE final settlement is calculated

Two wage bases, and why salary × years gets it wrong

The decree-law defines two different wages. The Basic Wage is the wage in your contract without allowances; the Wage is the Basic Wage plus allowances (Article 1). Article 51 puts gratuity on the first, and Article 29 says unused-leave pay is calculated on the Basic Wage too. Article 43 puts notice pay on the second.

So a settlement on AED 10,000 basic plus AED 5,000 allowances runs on two daily rates at once: AED 333.33 for gratuity and leave, AED 500 for notice and unpaid salary. A calculator that applies the full package to everything overstates the gratuity and leave lines by half; one that uses basic for everything understates the notice line by a third.

Resignation, unserved notice and the 14-day rule

Resigning no longer reduces anything. Since Federal Decree-Law No. 33 of 2021 took effect on 2 February 2022, gratuity is paid in full whether you resign or are terminated, and Article 29 pays every unused leave day either way. Dismissal for misconduct under Article 44 does not remove gratuity under the current law either.

Notice cuts both ways. Article 43 makes the party that does not observe the notice period pay the other compensation equal to the wage for the unserved days. If your employer ends the contract without letting you work your notice, enter those days as notice not served. If you leave without serving notice, your employer can claim the same amount from you, so enter it as a deduction instead.

Article 53 then requires your employer to pay all wages and dues within 14 days of the contract ending. If that deadline passes, raise it in writing and then file a complaint with MOHRE, which is free.

Leaving before one year

Article 51 pays gratuity only after one year of continuous service, so under a year the gratuity line is zero. That is not the same as a zero settlement. Annual leave accrues from six months at 2 days a month, and any notice pay and outstanding salary are owed whatever your length of service. The calculator shows those lines rather than returning nothing.

What this calculator does not include

Unpaid overtime is owed at settlement but is not included here, because it depends on your hours and the type of day each fell on. Calculate it separately and add it.

Also outside the statutory figures: anything your contract adds on top (for example a return ticket, if your contract promises one), and gratuity for any period your employer enrolled you in the voluntary Savings Scheme, where the fund balance replaces the Article 51 amount. The DIFC and ADGM run their own end-of-service rules and are not modelled.

Worked examples

6 years, AED 10,000 basic + AED 5,000 allowances, terminated

  • Gratuity: 5 × 21 + 30 = 135 days × (10,000 ÷ 30 = AED 333.33) = AED 45,000 (basic, Art. 51)
  • Leave accrued 180 days, 150 taken, so 30 unused: 30 × AED 333.33 = AED 10,000 (basic, Art. 29)
  • Notice not served, 30 days: (10,000 + 5,000) ÷ 30 = AED 500/day × 30 = AED 15,000 (full wage, Art. 43)
  • Outstanding salary, 10 days: 500 × 10 = AED 5,000
  • Gross settlement AED 75,000, less a AED 2,000 advance
Net settlementAED 73,000

Resigned after 9 months, AED 6,000 basic, no leave taken

  • Gratuity: none, because Article 51 requires one year
  • Leave: 9 months × 2 days = 18 days × (6,000 ÷ 30 = AED 200) = AED 3,600
  • No notice or unpaid salary owed in this example
Final settlementAED 3,600

Frequently asked questions

What is included in a final settlement in the UAE?

End-of-service gratuity, pay for unused annual leave, pay in lieu of any notice you were not allowed to serve, and salary still owed for days worked. Lawful deductions such as an advance or a loan are subtracted. Overtime that is still unpaid is owed too and is worked out separately.

How long does my employer have to pay my final settlement in the UAE?

Fourteen days from the end of the contract. Article 53 of Federal Decree-Law No. 33 of 2021 requires all wages and dues, gratuity included, to be paid in that window. If it is not, you can file a free complaint with MOHRE.

Is the final settlement calculated on basic or total salary in the UAE?

Both, depending on the line. Gratuity (Article 51) and unused leave (Article 29) are on basic salary only. Notice pay (Article 43) and outstanding salary are on the full wage, basic plus allowances.

Do I get a final settlement if I resign?

Yes, in full. Since February 2022 resignation does not reduce gratuity, and unused leave is paid whether you resign or are terminated. The one thing that can reduce it is notice: if you leave without serving your notice period, your employer can deduct the wage for the unserved days.

What happens if I leave without serving my notice period?

Article 43 requires the party that does not observe the notice period to compensate the other with the wage for the unserved days. So your employer can set that amount off against your settlement. In this calculator, enter it under deductions rather than under notice not served.

Do I get a settlement if I worked less than a year in the UAE?

You get a settlement but no gratuity, because Article 51 requires one year of continuous service. Annual leave accrues from six months at 2 days a month, and any outstanding salary or notice pay is owed regardless of length of service.

Does this final settlement calculator work for Dubai and Abu Dhabi?

Yes. It works as a Dubai settlement calculator, and for mainland employers in every other emirate, because Federal Decree-Law No. 33 of 2021 is federal. Most free zones follow it too. The DIFC and ADGM have their own employment laws, so a settlement there will not match this calculator.
